The Supreme Court has directed parties involved in the African Democratic Congress (ADC) leadership dispute to return to the Federal High Court for resolution of the case.
In a unanimous judgment, the apex court also set aside the earlier order of the Court of Appeal, which had instructed parties to maintain the status quo ante bellum.

Delivering the lead judgment, Justice Mohammed Garba held that the appellate court erred by raising the issue suo motu on its own initiative without prompting from any of the parties and then issuing the order to maintain the previous state of affairs.
The court further ruled that it was inappropriate for the lower court to grant any preservative order in a matter still pending before the trial court.
“The directive made (status quo ante bellum) after striking out the appeal and issuing an accelerated hearing was unnecessary, unwarranted and improper,” Garba stated.
